Kildare County Council (KCC) has released an update in relation to the taking in charge (TIC) process for one South Kildare housing estate.

According to the official KCC website: "TIC is a formal legal process by which responsibility for certain public areas, structures and services in a private residential development or estate are transferred to, or put in the charge of, a local authority [in this case, KCC].

"Section 180 of the Planning and Development Act, 2000, as amended and Section 11 of the Roads Act, 1993 provide the main legal basis for taking in charge."

And at the most recent Athy Municipal District (MD) meeting, which took place yesterday (December 8 last), Labour Party councillor Mark Leigh asked KCC to update the MD's councillors on the status of the TIC process in relation to Cluain Ard in Kilmead.

In response, KCC said via the report it presented at the meeting: "Cluain Ard is part of the legacy portfolio of estates within the Development Control Section of KCC.

"A valid TIC request was received in late 2022. Since then, CCTV surveys have been completed, and associated repairs to the underground infrastructure have been carried out."

KCC further said: "Development Control has also engaged with Uisce Éireann regarding the wastewater treatment plant serving the development, which has undergone improvement works funded by Uisce Éireann.

"Further progression of the TIC process for Cluain Ard is dependent on the resources available within the Legacy TIC Team."

KCC concluded: "Consequently, it is not possible to provide a definitive timeline for the taking in charge of legacy estates at this time."
