Kildare crash resulted in one car left on top of the other and both went on fire

A car finished on top of another vehicle and both went on fire following a road accident.

Before Naas District court was James Gill, 30, whose address was given as Kilrathmurray, Clonard, Enfield, was prosecuted for dangerous driving and having no insurance at Balyna, Carbury, on August 12, 2022.

Sgt Mary Meade told the court that the Panda car driven by the defendant finished on top of the roof of a BMW car and both vehicles went on fire.

She alleged that the Panda was being driven at speed and “appeared to be out of control.”

It was also claimed that the defendant left the scene.

Both vehicles were on fire when the gardaí arrived and nobody was injured in the incident.

The defendant was identified as the driver though he was not the registered owner.

Solicitor David Powderly said the case arose from a serious accident.

He said the defendant suffered a brain injury in 2002 and spent some time in hospital and he also said he had some difficulty with his judgement.

Mr Powderly added the defendant "naively thought” he was covered by insurance and he said he has poor cognitive ability. He added the car was owned by his girlfriend.

Judge Desmond Zaidan said it was a miracle that nobody was fatally injured in the accident.

He imposed a five months custody term and a six year disqualification for dangerous driving as well as a consecutive 5 months term for no insurance with a concurrent six year disqualification.
