Man is told to stay away from mother, partner, baby and a town in Kildare

A man facing prosecution for allegedly assaulting his partner and his mother on December 13 was given bail on condition that he stay away from both.

He appeared before Naas District Court in custody.

The court was told he has a child with his partner and his partner was living in emergency accommodation, but not because of the alleged assault.

His mother told Judge Desmond Zaidan that drugs are “eating up” her son, adding “he needs help not jail.”

She also said that efforts are being made by his family to get him into rehab.

Solicitor Tim Kennelly said the defendant had made a start to tackling his drug habit because he was in custody without access to drugs.

Judge Zaidan commented that if the defendant is taking drugs he cannot predict what might happen. He also said it was possible that the defendant would resume drug taking.

Judge Zaidan said he would accede to a bail request subject to conditions including that the defendant have no contact with the injured parties.

He said if this was breached the defendant would be brought back before the court.

The judge also said he is not to have any contact with the baby.

The man was also to stay away from a named address in Kildare and to live at a named address. He just sign on once a week at a garda station and observe a curfew between 11pm and 6am.

Judge Zaidan told the defendant that if he cleans up his act and "show me that you have changed your ways” he could relax these conditions in the future.

He adjourned the matter for DPP’s direction to May 28.
