Sandwich theft case should not have come before Kildare court - Judge

The case against a man prosecuted for stealing a sandwich worth €2 should not have come before the court, according to a judge at Naas District Court.

Judge Desmond Zaidan said he believes that cases like these should not be in court and legislation needs to be changed.

The man was also prosecuted for stealing four bottles of wine.

Referring to the sandwich theft, the judge said that an adult caution - an alternative to prosecution where there is evidence of an offence but it’s not in the public interest to deal with it in court - might have been applied.

The court heard that the incident took place at an Aldi store.

Judge Zaidan said if it was up to him, he would apply the Probation Act.

He said if he took an alternative course “I can see the headlines on RTE -  ‘Judge sentences man for stealing sandwich’.”
