Judge marks alleged Kildare town assault case peremptory against the State

A Naas District Court judge has marked an alleged Kildare town assault case peremptory against the State.

This means that the matter will go ahead on the next date with no further applications for adjournment to be granted (in this case, to the State), and if the relevant preparation is not ready on the next date, then the case could face being struck out by the presiding judge.

The decision was made by Judge Desmond Zaidan on Thursday, September 12, in relation to a case involving one Shane Kenny, of 3524 Bishopsland in Kildare town.

Back in July, gardaí claimed that the 30-year-old defendant allegedly assaulted a person from behind at Nugent Street in Kildare town on September 1, 2019.

On the latest court date, Garda Sergeant David Hanrahan told Judge Zaidan that there were still no directions from the Director of Public Prosecutions (DPP) in relation to the case involving the accused.

When the judge asked why this was the case, Sgt Hanrahan replied that it was unknown why there were no DPP directions.

Judge Zaidan decided to adjourn the case to February 13, 2025, to allow time for DPP directions.

He also marked the case peremptory against the State.
