A Naas District Court judge struck out an alleged domestic violence breach case on Thursday, June 27 last.
The case was heard in-camera (in private) before Judge Desmond Zaidan.
Gardaí alleged that a man breached a protection order, which was brought against him by his ex-partner.
A garda who was sworn in told the judge that the man allegedly threatened to put his ex-partner in jail.
The same garda added that there was no objection to bail being granted for the accused.
He also said that the man and woman have a child together, and are currently in the middle of a break-up.
"The injured party was upset when she gave a statement to gardaí," the garda told the judge.
Judge Zaidan pointed out the exact language that the man allegedly used: according to gardaí, the man specifically said: "If you break the law, I will make sure that you will be put in jail."
The judge described this as a 'blanket statement', not a direct threat (specifically with regards to the word 'if'), and as such, decided to strike-out the case.
The defendant will return to court at a later date for hearing.
