A Naas District Court judge decided to apply the Probation Act in the case of an elderly woman with 'serious health issues.'
Judge Desmond Zaidan made the decision at Naas District Court on Thursday, October 19, in the case of an elderly woman accused of a shoplifting offence.
Gardaí told the judge that all of the items she stole were recovered.
The woman pleaded guilty to the offence and has no previous convictions.
After reading a medical report which was handed in to him, Judge Zaidan told the woman (as well as her defending solicitor, Joe Coonan): "I have read the report and it makes for grim reading.
"It's surprising that she's even here... it's not for me to say, but perhaps her medicine made her forgetful (on the day)."
He continued: "She has serious health issues, and I feel like if she was going to behave like this (referring to her shoplifting offence), she would not start now."
Following his brief speech, the judge applied the Probation Act.
