KILDARE COURT: Young woman detained in prison because no alternative accommodation available

Roles reversed in Naas Courthouse as solicitors told what to do

A young woman was being detained in prison because no suitable accommodation was immediately available to her.

The woman is aged in her 20s and was prosecuted for a breach of the Public Order Act at Naas Hospital on March 13 last.

The woman, who was accompanied to a Naas District Court sitting by her parents, has alcohol and mental health issues.

Judge Desmond Zaidan criticised the delay in finding a suitable residential place, noting that the woman cannot live an independent live.

The judge commented that she needs structure in her life.

He said someone could take advantage of the woman or provoke her.

“She should be in a place that caters for her needs,” he said and addressing her parents adding “I find this hard, I can imagine how you feel.”

Judge Zaidan said he would not be doing her or the community any good by releasing her and he noted a marked improvement in her appearance since being detained.

He also said he as not comfortable keeping her in prison “as a judge and a human being.”

But, she needs a secure place where she can live independently.

The woman’s parents indicated that a place is available in a setting in Cork, which is approved by the HSE  but it is unclear how this would be funded.

Solicitor David Powderly said that the prison authorities had come up with an offer of homeless accommodation - but this is not suitable.

The matter was adjourned.
