A man found with a wine bottle on the seat of his car which was parked on the M7 motorway at Greyabbey, Kildare, at 9.20am on September 1, 2017, has been been fined a total of €1,500 and given three four-year driving bans, to run concurrently.
At Naas District Court on March 14, the court heard that Warren McPhail,28, 6 Knockmore Drive, Tallaght, was found by Garda James Farragher parked on the hard shoulder of the road. There was a half bottle of wine on the passenger seat beside him.
Tests showed he had a 56mg breath alcohol reading.
Mr McPhail was driving when disqualified at the time and had 16 previous convictions, including two relating to drink driving.
Conal Boyce, solicitor for Mr McPhail, said his client's mother had died a short time before the incident and he had “a chaotic lifestyle” at the time. Mr Boyce said Mr McPhail had pulled his life back together again. Garda Farragher said Mr McPhail was very cooperative.
The defendant was fined €500 and banned on each of three charges — drink driving, driving without insurance and a driving licence.
