Couple charged with wasting Garda time after Blessington traffic accident

The case was heard in Naas

A Polish couple appeared at Naas District Court last Thursday, March 22, both charged with wasting Garda time.

Kamil Malek, 32, and Monika Malek, 37, with an address listed as 22 Lakeshore Holiday Village, Blessington, pleaded guilty to the offence.

The couple were in a traffic accident last February 23, 2017, at Haylands, Blessington, and when approached by Gardai, claimed that Monika was the driver, whereas in fact Kamil , who was not insured to drive the car, was in fact the driver of the vehicle.

His driving license had also expired.

The deception was quickly discovered by investigating Garda Maxwell using CCTV and the couple were fully cooperative from that moment, the court heard.

A wall had been damaged in the incident and the couple have paid for the repair.

While Monika Malek only had a previous conviction for speeding, Kamil served time in his native Poland for a charge of drink driving associated with a traffic accident in 2005.

The pair have two children and were apologetic for their actions.

Representing them, barrister Sarah Connolly told Judge Desmond Zaidan that the couple are “decent people” and they are both employed.

She added that Mr Malek’s previous conviction was of some antiquity when he was a young man.

The pair were fined €750 each.
