‘You don’t have a duty of care to him’

A woman, aged in her large 70s was told by a judge that her son has to leave the home if she does not want him there.

The woman came to Naas District Court seeking protection.

She alleged that her son, aged about 30 years younger than her, has a problem with alcohol, especially vodka.

She further claimed in court that he “can be very abusive verbally” and when he is under the influence he says things “that wouldn’t be him normally."

The woman agreed with Judge Desmond Zaidan that there is “not a bother on him” without alcohol.

She said he does not behave normally with alcohol.

“I’m sorry you’re going through this,” Judge Zaidan told the woman, who was accompanied to court by another adult child. Her son was not present or represented.

Judge Zaidan told her that because her son is over 18 years of age ”you don’t have a duty of care to him.”

He added: “If you no longer want him in your house, he has to leave because he is trespassing.” He added she did not need a court order to tell him to leave.

Judge Zaidan granted the woman an interim protection order and said he would ask the gardaí to serve this on him.

The judge said he would include the woman's husband (who was not present because he was not well enough to attend) in the order adn he adjourned the case for a fuller hearing on December 14.
