No bail for man accused of assaulting another who was knocked unconscious, tied to a bed and stabbed

Allegation
A bail application for a man accused of assaulting a victim, who was tied to a bed and stabbed, was refused at Naas District Court.
John Coyne, 30, whose address was given as 23 Grove Heights, Robertstown, is one of three defendants who were charged with alleged assault at 13 Grove Heights, Robertstown, on March 14 last.
The defendant appeared in court and frequently interrupted proceedings prompting Judge Desmond Zaidan to ask if he was under the influence of anything.”
He was before the court on additional allegations of false imprisonment and production of an article on March 14 last, also at 13 Grove Heights.
A previous court hearing heard it would be alleged the injured party got a phone call from inviting him to a house in Robertstown and that the parties are known to each other.
It was claimed the injured party, a man from Kildare town, was beaten by the defendants and he was stabbed, a brush handle was broken and a rum bottle was used in the incident.
The court was told that a phone charger and cable were also used.
It was stated that the incident occurred over a woman that the injured party is dating and who was previously dated by John Coyne.
It was further claimed that the injured party was knocked unconscious and tied to bed posts.
Detective Garda Wayne Kelly objected to the granting of bail and said the defendant was not at his address during curfew hours on January 7 at 7.30pm.
Det Gda Kelly said no conditions would satisfy him in relation to bail.
Detective Garda Darren Moulton said when he called to the defendant’s address on January 5 his father was there and said the defendant was not present.
The defendant said he could not comply with some bail conditions because he had a hospital appointment and on another occasion he was in the shed “fixing a scrambler” and his mother was unaware of this, adding the woman is “half deaf in one ear”.
He said he has had seizures and had problems with his heart and did not breach bail conditions in a long time.
Defending solicitor Tim Kennelly pointed out the alleged injured party was not present in court and he said the defendant has quite a good record of attending court.
Judge Desmond Zaidan said he had refused bail previously which was granted in the High Court.
He said he took exception to a comment by the defendant that he refused bail 99% of the time and said he always gave reasons based on law when deciding bail applications.
The judge also said he had concerns about the defendant’s demeanour in court.
He said he court can draw inferences from the facts given in evidence when deciding on a bail application and the more serious the allegation the more likely it is that someone would breach bail
He was satisfied beyond a shadow of a doubt that the objections were well founded in law.
The defendant was remanded in custody.
Judge Zaidan added that the defendant had taken something and was under influence. Therefore he should be medically examined in custody.
