Ten year ban imposed
Athy District Court.
An Athy man found to have driven three times without insurance over a two year period has been disqualified from driving for ten years and given a three month suspended sentence.
Myles Flynn, 11 Ardrew Court, Dunbrin, got a ten year ban on each of the three offences but these will run at the same time. In addition he was given a three month suspended sentence on each charge.
The first offence took place in 2010 and the the second two in late 2011.
Mr. Flynn pleaded guilty to all three charges.
The Court was told he was stopped driving his car on 22 December 2011 at a time when he was disqualified.
Before the three offences, he had two previous convictions and he had been disqualified from driving for two years from 21 January 2010.
Judge Patrick Clyne was told that Mr. Flynn (32) had four children and his wife suffered from a serious medical condition which left his as carer at times. He was under a huge amount of strain. This was not an excuse for the offences, however, and a jail sentence was a possibility.
At the initial stage of the hearing, the Judge said Mr. Flynn had cocked his snoot at the Court on three occasions.
If he had crashed bringing his children to school, said Judge Clyne, there would be no insurance to meet any costs.
The Judge noted that Mr. Flynn was driving quite a good car, relative to his own “jallopy.”
He opted to suspend the jail sentences, saying he could have put the defendant away for 18 months, but told Mr. Flynn that he would be off the road until his children were married.
