Fined for ‘holding but not using’ mobile

Beware of holding your mobile phone while driving. You could face a prosecution for merely holding it rather than using it.

A man who was holding his mobile but not, he claims, using it was fined €250 at Naas District Court last Wednesday, May 9.

Shane O’Reilly whose address is listed as 21 Kildare Drive, Tallaght was spotted by Sgt. James O’Meara on November 30 last at Greenhills, Kill holding his mobile phone.

He told Judge Desmond Zaidan that he was guilty of holding the phone, but not of using it.

“Yes, but you’re not charged with using it, you’re charged with holding it,” the Judge informed him, before fining him.
