Athy drug dealer jailed for three years
A drug dealer who had to have his skull reconstructed after being beaten with a golf club was yesterday jailed for three years at the Dublin Circuit Criminal Court.
Brian Murphy (35) of Rheban Manor, Athy, Co Kildare pleaded guilty to possession of heroin for sale or supply at Deansrath Grove, Clodalkin, Dublin on October 13, 2008.
Garda David Brennan told Colm O’Briain BL, prosecuting, that during a search of Murphy’s previous home at Deansrath Grove, gardai found 237.9 grammes of heroin.
He told Dublin Circuit Criminal Court that this had a market value of €47,508. Gardai also found €700 worth of cannabis resin.
The heroin addict admitted to gardai that he was in the business of selling cannabis resin but that he had just received the heroin.
Gda Brennan said Murphy told them he was to pass it on and receive €7,500 for it. The court heard Murphy was only to keep €200 of this cash for himself and he would have a separate debt of €200 written off.
Defence counsel John Byrne BL said his client suffered a catastrophic injury during an assault on September 18, 2010.
He was struck in the back of the head with a golf club and his skull caved in, leaving him with life threatening injuries. The father of two had his skull rebuilt with titanium plates.
Mr Byrne said Murphy’s life fell apart when a leg injury ended a promising football career and he began drinking and smoking heroin.
The court heard that Murphy’s family were very supportive and did everything they could to help him, including sending him to Poland for treatment.
Murphy told gardai that he couldn’t say who owned the heroin because there were people getting shot for it.
Murphy has 38 previous convictions and he received a suspended sentence of three years for drug dealing in 2004.
Judge Martin Nolan imposed a sentence of three years imprisonment.
