Kildare town woman evicted from local social housing project

A Kildare town woman has been evicted from a social housing project after evidence was heard in court of anti-social behaviour by her partner, and of housing rent arrears.

At Naas District Court on Monday, 17 February, Paula O’Reilly, 13 Oakland Grove, Dunmurry road, Kildare, a mother of two, was evicted following a case taken by the Cill Dara Housing Association Company Ltd.

Cill Dara, represented by Seamus Boyle, solicitor, and Dan Boland, B.L, argued that Ms. O’Reilly, whose rent is now €48 per week, owed €1,193 in arrears up to December 2013.

Evidence was also given that Ms. O’Reilly’s partner, was engaging in anti-social behaviour, including allegations of illegal drug dealing, even though Ms. O’Reilly herself was not.

Garda Niall Carthy said that her partner had 28 previous convictions, including 16 road traffic convictions and ten for theft, but none for drug dealing.

David Gibbons, solicitor, representing Ms. O’Reilly said she was never arrested or charged with drug dealing.

Paul Hyland, manager of the estate, said Ms. O’Reilly, had been arrears from 2008 up to July of last year. He also said she needed the agreement of the housing association before a partner could live with her.

Mary Kavanagh, a neighbour giving evidence on behalf of the Association, said the Gardai and the drug squad regularly visited Ms. O’Reilly’s house. Ms. O’Reilly was a good tenant until her partner arrived but she was “a facilitator” of anti social behaviour, she said.

The Court heard her partner would soon be sentenced soon after pleading guilty to robbery.

Mr. Gibbons said Ms. O’Reilly would give an undertaking on rent payments and that her partner would leave the house. He also said her rent had gone up from €34 to €48 a week and that she was trying to pay the arrears.

Judge Desmond Zaidan opted to evict Ms. O’Reilly but he put a stay of two months on the order.
