A LOCAL district court judge has refused to hear a case involving a man who is charged of having child pornography on his computer.

A LOCAL district court judge has refused to hear a case involving a man who is charged of having child pornography on his computer.

David Kilduff, 34, whose address is listed as 97 Loughbollard, Clane appeared before Judge Desmond Zaidan last Wednesday, April 17, charged with have seven child pornographic images on his computer on May 30, 2011 at the same address.

The court heard that the Director of Public Prosecutions has indicated that the case for disposal summarily and that a fine of €1,500 of would apply if the defendant pleaded guilty.

This suggested that the DPP viewed the charge as being at the more minor end of spectrum.

Judge Zaidan asked Inspector Patsy Glennon about the nature of the pictures.

One featured an adult male, with his penis exposed, with a girl under the age of 17, the Inspector explained. Another featured a female under the age of 10, engaged in the act of oral sex on a man.

“I differ from the DPP, it’s not a minor allegation,” he said. And he refused jurisdiction. The matter has been adjourned.
