A man who was before Athy District Court for careless driving was fined E600 last week.
Cezary Wielechowski, with an address listed as 23 The Paddocks, Crookstown, Athy, was stopped by gardai on November 6, 2011 at The Paddocks.
The court heard that gardai observed the car “going over and back” on the road and so pulled the driver over. It was a very frosty night and the court was told that the defendant’s window’s were frozen over.
“Common sense should have prevailed,” the solicitor for the defendant said Mathew Byrne.
“He should have waited for the windows to become clear.”
The defendant was described in court as a man of limited means who drives for a living.
Judge Desmond Zaidan said the defendant, who had no previous convictions, was very fortunate on this occasion.
“He is a driver by trade – it’s frightening,” he said. “It was frosty, he didn’t slow down, he is very fortunate on this occasion”.
